Terms of Service
Version 0.1 (draft) · Effective 26 October 2026
1. Who we are and what these terms cover
Maison Calibre is operated by Berk Strategic Ventures LLC, doing business as BSV Soft ("BSV Soft"), a limited liability company incorporated in Washington, with its postal address at 2378 127th Ave NE, Bellevue, WA 98005, USA ("we", "us"). Phone: (425) 376 2691. Contact: info@bsvsoft.com.
These terms govern your use of maisoncalibre.watch (the "Site"), your Maison Calibre account, and the watch faces and related services we provide (together, the "Service"). By creating an account, buying, activating or using a face, you agree to these terms. If you do not agree, do not use the Service. These terms work together with our Privacy Policy, Refund Policy, Subscription Terms, Acceptable Use Policy and Cookie Notice. If you join one of our programs (VIP creator, Ambassador or Beta tester), the program's own terms also apply.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or buy. If you are younger, a parent or guardian must buy and manage the account for you and accepts these terms on your behalf. You confirm that the information you give us is accurate.
3. Your account
You sign in with your email address and a link we email to you. You are responsible for your email account, for activity under your Maison Calibre account, and for keeping your sign-in links private. Tell us promptly at info@bsvsoft.com if you think someone else has access. You may buy as a guest at checkout; we then create an account for the email address you give.
Emails. Service emails are part of the Service and you cannot opt out of them while you have an account: sign-in links, account and security messages, receipts, renewal and price-change reminders, credit-expiry reminders, and emails about a program you joined. We send marketing emails (news, offers, new faces) only if you separately agree, for example by an unticked box at sign-up or checkout, and agreeing is never a condition of buying. You can unsubscribe from marketing emails at any time with the link in each one, or by writing to us.
An account may link up to two (2) watches at a time. You can remove a watch and link another.
4. Licence to use watch faces
A licence, not a sale. When you buy, activate or receive a face, you get a licence to use it. You do not buy the software, the artwork or any intellectual property in it. We keep all rights not expressly granted.
What the licence is. A limited, non-exclusive, non-transferable, non-sublicensable licence to install and use the face for your personal, non-commercial use on up to two compatible Garmin watches linked to your account. We may revoke it only as set out in these terms.
What it is not. It cannot be sold, lent, shared, rented, gifted or transferred to another person or account, and cannot be used on watches that are not linked to your account.
Installation. Faces are installed from Garmin's Connect IQ store and unlocked by our licence service. Faces depend on Garmin's platform, store and devices, which we do not control. A face is licensed while it is offered and compatible with your watch. If we stop supporting a face we will give reasonable notice where we can.
5. Editions, bundles, memberships and credits
- Editions. Each face comes in three editions: Essentiel, Signature and Grand Atelier. Higher editions add features and complications. Prices and contents are shown on our pricing page and at checkout, in US dollars unless stated otherwise.
- Bundles. You can buy two to four different faces in one checkout, in any editions, at a discount on the sum of their prices: 10% off for two faces, 20% off for three and 30% off for four. You own each face forever at the edition you chose. A bundle needs an account and a linked Maison Key. We do not sell edition upgrades.
- Colourways. Every face edition you buy includes all of that face's colourways at no extra charge. We do not sell colour packs or single colourways. Exclusive Atelier colourways belong to Grand Atelier editions, and to memberships at that level.
- Memberships. A Founders membership gives access to every face at your membership tier, including future faces, while the membership is active. Membership pricing, renewal and cancellation are set out in the Subscription Terms. Faces you only have through a membership stop unlocking when the membership ends.
- Keep-forever credits. Members earn "keep forever" credits as described in the Subscription Terms. A credit is tagged with the edition level of the membership at the time it was earned, and turns one face, at or below that level, into a face you own. Owned faces stay yours after the membership ends. Unused credits can expire after a membership ends, as set out in the Subscription Terms. Credits have no cash value and are not transferable; refunding a payment revokes only the credits that payment earned. We may change how credits are earned for future periods with notice.
- Free face. Everyone who signs up receives one free face, which we may change from time to time. Once you have an account, the free face stays fully unlocked.
- Customization subscription (coming later). We plan to offer a separate subscription for custom logos and extra text beyond the free engraving, together with a logo studio that is not yet available. Its prices are shown on our pricing page, and it will be governed by the Subscription Terms.
6. Free trial, prices, payment and refunds
A newly installed face shows its sealed dial (the time is always free) with a QR code. Scanning it and signing in with your email starts your free trial (one per account): for 3 days, every Maison Calibre face you activate with the same account is fully unlocked, and the trial ends for all of them at the same time. Each account (each email address) gets one trial. When the trial ends, or when a membership you rely on ends, the face goes to a sealed dial: a dimmed dial with plain hands and an activation QR code, and its complications stop working. The sealed dial is not a use of the face you have paid for. After a trial, a face you have not activated stays on the sealed dial, and nothing is charged. Activating the face (or renewing the membership) unlocks it again.
Prices and the payment fee. A face costs $4.99 (Essentiel), $6.99 (Signature) or $8.99 (Grand Atelier); bundles and memberships are priced as shown on our pricing page. We cover the payment fee on faces, bundles and annual memberships. On monthly memberships you pay a visible payment fee of $0.49 on top of the monthly price, shown before you pay and never added later. Sales tax or VAT is shown at checkout (in the EU and UK, shown prices include VAT). If you buy a face on its own and take an annual membership within 30 days, the price of that face comes off your first membership payment (counted once; the first payment is never below $4.99). If an order is refunded, the whole amount you paid is refunded, including any payment fee.
Orders are processed by Polar (the "Merchant of Record"), which sells to you, collects payment and applicable sales tax or VAT, and issues invoices. Its terms apply to the payment transaction, and we do not see or store your card details.
Refunds. You can refund any charge (a first purchase, an upgrade or a renewal) instantly from your account within 14 days of that charge, no questions asked, as set out in our Refund Policy. The licence and anything the payment earned (such as credits) are revoked, so the face returns to its sealed state, and refunding a membership charge cancels the membership. One automatic refund applies per account in any rolling 12 months; requests over the limit or after 14 days go to manual review, and duplicate charges and technical faults on our side are always refunded. At checkout you confirm you want immediate delivery of digital content and, if you are in the EU or UK, that you lose your statutory 14-day right of withdrawal for that face once delivery begins; our 14-day refund is separate and more generous. New memberships work differently for EU and UK consumers; see the Subscription Terms and Refund Policy. This does not limit rights you have under mandatory law, including the legal guarantee that digital content matches its description and works as expected.
7. Acceptable use and intellectual property
Our faces, their artwork, names, the Maison Calibre and Maison Key names, logos, references and marks, and the website and software, belong to us or our licensors and are protected by copyright, trademark and other laws. You must follow our Acceptable Use Policy. In particular you must not:
- copy, extract, decompile, reverse engineer or modify a face, the licence service or its keys, except where mandatory law allows it;
- share, sell, rent, lend or publish licences, activation codes, links or keys, or use them on watches not linked to your account;
- bypass, disable or interfere with licence or trial checks, or use pirated copies of our faces; or
- use our names or marks without our written permission.
We may suspend or end accounts that do, and we may take other action the law allows. To report infringement, see our DMCA and IP notice.
8. Third parties
- Garmin. Maison Calibre is an independent product and is not affiliated with, endorsed by or sponsored by Garmin Ltd. or its subsidiaries. Garmin, Connect IQ, fēnix, epix, Forerunner, Venu and vívoactive are trademarks of their owners and are used only to describe compatibility. Garmin's own terms govern your watch, your Garmin account and the Connect IQ store.
- Merchant of Record. See section 6.
- Hosting and other providers. We use service providers, including Supabase (database and sign-in) and Vercel (website hosting), to run the Service. See the Privacy Policy.
We are not responsible for third-party services, and their outages or changes may affect the Service.
9. Disclaimer of warranties and accuracy of metrics
THE SERVICE AND ALL FACES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE GREATEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, secure or error-free, or that faces will work on every device or software version.
Watch faces and displayed metrics may occasionally show wrong, delayed, or inaccurate information. Faces display time, date, battery level, steps, heart rate, activity, moon phase, weather, and other fitness, sensor, or system metrics. This information originates from your watch hardware, onboard sensors, Garmin's Connect IQ platform, or third-party data feeds. Due to sensor variance, synchronization delay, software bugs, background process limits, or operating system updates, watch faces may occasionally display inaccurate, incorrect, outdated, or incomplete data, or fail to refresh. We do not warrant, represent, or guarantee the accuracy, completeness, timeliness, or reliability of any metrics, complications, or data shown on any face. You agree that you will not rely on any watch face or its metrics for critical timekeeping, navigation, medical, safety, or athletic decisions.
10. Assumption of risk
Installing and running third-party software on your watch carries risk. You accept those risks, which include loss or corruption of data, faster battery drain, malfunction or crashes, display problems, and other issues with your device or its software. You are responsible for keeping your watch updated and for backing up your data.
11. Limitation of liability
TO THE GREATEST EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PRIVACY INCIDENTS, DAMAGE TO YOUR WATCH, PHONE OR OTHER DEVICES, OR ANY LOSSES, INJURIES, CLAIMS, OR DAMAGES ARISING OUT OF OR RELATING TO INACCURATE, WRONG, ERRONEOUS, DELAYED, OR MISSING METRICS, DATA, OR INFORMATION SHOWN ON ANY WATCH FACE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND
- OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places do not allow some of these limits, so they may not apply to you in full. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to exclude.
12. Indemnity
You will defend and indemnify us, our officers, employees and contractors against claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these terms, your misuse of the Service, or content you submit that infringes someone else's rights. This does not apply to the extent the law does not allow it, including where mandatory consumer law protects you.
13. Health and safety
Maison Calibre faces are decorative and functional watch faces, not medical or navigational devices. They are not intended to diagnose, treat, monitor or prevent any medical condition, nor to provide guaranteed navigation or time-critical guidance. Do not rely on a face for medical decisions, health emergencies, sports safety, or navigation; always use dedicated, certified professional equipment and consult a qualified healthcare professional. We assume no liability for any reliance placed on metrics or information displayed by our faces. Do not look at or interact with your watch while driving, cycling or doing anything else where that would be unsafe.
14. Changes to the Service and to these terms
We may change the Service, and we may update these terms. If you are a consumer in the EU or UK, we change the Service you have paid for only for a valid reason, at no extra cost to you, and with notice. For material changes we will give notice, for example by email or by a banner when you sign in, before they take effect, and we will ask you to accept the new terms. If you do not agree to a change, you may stop using the Service and cancel your membership. Using the Service after a change takes effect means you accept it, where the law allows. The version number and effective date at the top of this page show which version applies.
15. Termination
You may stop using the Service at any time and may ask us to delete your account. We may suspend or end your account or licences if you materially breach these terms or the Acceptable Use Policy, or if the law requires. Memberships end as set out in the Subscription Terms. Sections that by their nature should survive (including 7, 9 to 12 and 16 to 18) survive termination.
16. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules, subject to section 18.
17. Disputes: informal resolution and individual arbitration
Before starting a formal dispute, you agree to contact us at info@bsvsoft.com and try to resolve it informally for 30 days.
If the dispute is not resolved, and to the extent permitted by law, you and we agree that any dispute arising out of or relating to these terms or the Service will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and held in King County, Washington, or remotely. You and we waive the right to a jury trial and to bring or take part in a class, collective or representative action. Either of us may bring an individual claim in small-claims court. You may opt out of arbitration within 30 days of first accepting these terms by emailing info@bsvsoft.com with the subject "Arbitration opt-out".
18. Consumer rights in the EU, UK and elsewhere
Nothing in these terms limits rights you have under mandatory law. If you are a consumer in the European Union, the United Kingdom or another place with mandatory consumer protection, you keep those rights, including any right to bring proceedings in the courts of the place where you live, and any limits and exclusions above apply only to the extent the law allows. If you have a complaint, write to us at info@bsvsoft.com and we will try to resolve it. Section 17 does not apply where it would remove such rights.
19. General
These terms, with the documents they link to, are the entire agreement between you and us about the Service. If a part is found unenforceable, the rest stays in force. Our not enforcing a right is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger, sale or reorganisation. We are not liable for delays or failures caused by events beyond our reasonable control.
